Indecent Images Investigation - No Further Action
Our client instructed us to provide pre-charge representation after they had been arrested on suspicion of possessing and distributing indecent images of children. We successfully made several applications to the court to vary and eventually remove our client’s bail conditions which restricted contact with his own children. We submitted representations to the police identifying the reasons why we felt their case failed on evidential grounds. The police decided to take no further action against our client. Our client was of good character and so his reputation and employment was on the line.

Historic Sexual Assault Allegation - No Further Action
Our client instructed us to provide pre-charge representation regarding allegations of historic sexual assault. Our client was living and working abroad at the time and so we arranged a suitable date/time for the client to attend a voluntary interview, therefore avoiding the risk of arrest. We obtained disclosure in advance of the interview and drafted a prepared statement on our client’s behalf denying the allegations. We represented our client in police interview and subsequently submitted representations on his behalf to the police evidential review team asserting the reasons why we believed the case did not pass the evidential threshold and therefore no further action should be taken. Our representations were successful and the police took the decision to take no further action against the client. The case was not referred to the Crown Prosecution Service.

Rape Allegation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for Rape. Having taken detailed instructions from our client it became apparent there were significant lines of enquiry which we were able to pursue, including speaking with and taking a statement from a key witness. This evidence significantly undermined the allegation that had been made against our client and cast doubt over the credibility of the complainant. We put a bundle of evidence together with representations which we submitted to the police asserting that their case failed on evidential grounds. After a review of this material the police took no further action against our client.

Rape Allegation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for Rape. We were able to successfully negotiate a voluntary interview with the police and therefore prevented our client from being arrested. We obtained disclosure prior to the interview and drafted a prepared statement in which we advanced evidence in the form of social media messages which undermined the complainant’s account. We subsequently obtained a witness statement from a key witness which further assisted our client’s defence. We provided this evidence to the police along with representations highlighting the weaknesses in their case. No further action was taken against our client.

Historic Sexual Abuse Allegation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for historic sexual offences against a family member. We arranged a voluntary interview and obtained disclosure from the police in advance. We took instructions from our client who highlighted some significant concerns regarding the complainant’s mental health and recent psychiatric treatment. We drafted a prepared statement putting forward our client’s denials and defence. We followed this up with representations to the police highlighting our concerns regarding the reliability of their evidence. No further action was taken against our client.

Public Order Offence - Charges Dropped At The First Hearing
Our client had been charged with a public order offence and informed they were required to attend court to enter pleas. We were instructed to represent our client in this matter and we obtained a copy of the Initial Details of the Prosecution Case (IDPC). Having reviewed the evidence and taken our client’s instructions we quickly formed the view that there was a strong self-defence argument available to our client. We submitted representations to the Crown Prosecution Service taking them through the events in the CCTV footage step-by-step. We also presented evidence of our client’s previous exemplary character. Upon our attendance at court we spoke with the prosecutor and further advanced the argument that our client was acting in self-defence and requested a review of the case. The prosecutor considered our representations and agreed to discontinue the case against our client there and then.

Indecent Images Investigation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client. Our client was under investigation for being in possession of indecent images of children. Our client had been interviewed once before and was represented by the duty solicitor on that occasion. We obtained copies of the previous solicitors notes and disclosure. We took instructions from our client and identified a statutory defence available to him. The police requested a second interview for which we arranged a voluntary attendance for our client. We obtained some further disclosure in advance of the interview in which we were notified that a number of indecent images had been recovered from our client’s phone. We drafted a prepared statement which set out our client’s defence, namely that the indecent images had been sent to him in a group chat on whatsapp without solicitation and he deleted the images immediately. We subsequently submitted representations to the police and Crown Prosecution Service with supporting evidence and character references. The prosecution took no further action against our client.

Grievous Bodily Harm And Affray - Charges Dropped
We were instructed to represent our client at court after she had been charged with Assault Occasioning Grievous Bodily Harm and Affray. We represented the client at her first hearing in the Magistrates court where not guilty pleas were indicated. The matter was sent to the Crown Court for a plea and trial preparation hearing. We undertook a detailed review of the evidence including witness statements and CCTV footage of the event. We took instructions from our client and drafted detailed representations to the CPS identifying significant weaknesses in their case against our client. We then participated in several phone calls with the prosecuting lawyer before they agreed to discontinue the entire case against our client.

Actual Bodily Harm - No Further Action
We were instructed to provide pre-charge representation on behalf of two client’s who were both under investigation for Assault Occasioning Actual Bodily Harm. The incident related to an alleged assault on a bouncer in a nightclub. We obtained a mental health report on behalf of one of our client’s which documented previous traumatic experiences and a diagnosis of Post-Traumatic Stress Disorder. We then highlighted these issues to the police with representations that both of our client’s were acting in self-defence or defence of each other. The police took no further action against both client’s.

Racially Aggravated Assault - Acquittal After Trial
We were instructed to represent our client at trial for offences of 2 x racially aggravated assaults, racially aggravated public order and domestic assault / racially aggravated domestic assault. Our client pleaded guilty to the alternative 2 x non-racially aggravated assaults at the first hearing. We undertook robust trial preparation and established some key lines of enquiries by carefully considering the CCTV footage and Body Worn Video. This highlighted that one of the witnesses claimed to have seen part of the incident which was not possible based on the footage. On the day of the trial we persuaded the prosecution to withdraw the charge of racially aggravated public order. After trial our client was found not guilty of the racially aggravated assault x 2 and racially aggravated domestic assault. The client was convicted of domestic assault. After sentence for the assault x 2 and domestic assault the client was made subject to a community order.

Coercive And Controlling Behaviour / Domestic Assault Investigation - No Further Action
We were instructed by our client to provide pre-charge representation in relation to allegations of domestic assault occasioning actual bodily harm along with further historic assaults and coercive and controlling behaviour. We took detailed instructions from our client about the relationship and identified witnesses who could corroborate our client’s account that the complainant was in fact the controlling and manipulative party in the relationship. We obtained several witness statements which significantly undermined the credibility of the complainant. We presented these to the police alongside written representations that the prosecution case did not pass the evidential stage. A decision of no further action was taken against the client.

Indecent Images Investigation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client in relation to allegations of harassment / grooming and possessing indecent images of children. We obtained detailed instructions from our client who adamantly denied the offences and provided names of several witnesses who could support his case. We obtained witness statements from these individuals as well as multiple character references on our client’s behalf. Following the analysis of the client’s phone, no evidence was found to corroborate the complainant’s allegations. We submitted the evidence we had obtained and No Further Action was taken against our client.

Assault / Public Order Investigation - No Further Action
We were instructed by our client to provide pre-charge representation following her arrest for assault occasioning actual bodily harm, drunk and disorderly, public order and possession of cannabis. Our client was of good character and worked in a regulated industry so there were potentially severe consequences if charged. We obtained detailed instructions from our client and presented representations to the officer in charge of the case. The police decided to take no further action against the client for Assault Occasioning Actual Bodily Harm, Drunk and Disorderly and s.4a Public Order. The client accepted a community resolution in respect of the offence of possession of cannabis.

Rape Allegation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client following his arrest on suspicion of Rape. Our client was a student at the time. The complainant alleged that the client had sexual intercourse with her when she was too drunk to consent. After continued conversations with the officer in charge of the case regarding their evidential difficulties the police decided to take no further action against our client.

Indecent Images - Charges Dropped Prior To Trial
We were instructed to represent our client after he had recently been charged with offences of being in possession of indecent images of children. We obtained the initial details of the prosecution case and reviewed this with our client. Our client’s instructions were consistent with a not guilty plea on the basis that he was not aware of the presence of this material on his devices. Our client entered not guilty pleas in the magistrates court and his case was sent to the crown court. At the plea and trial preparation hearing we advanced elements of the clients defence to the prosecution and requested further forensic examination of the devices. Having obtained this further report, and in light of the issues that we had raised in the client’s defence, the prosecution offered no evidence against our client in respect of all charges.

Indecent Images Investigation - No Further Action
We were instructed to provide pre-charge representation on behalf of our client following his arrest on suspicion of Possessing Indecent Images of Children. Our client had already been interviewed and was represented by the duty solicitor. Once we were instructed we took detailed instructions from our client and instructed a psychiatrist to conduct a psychiatric assessment. After our client’s electronic devices were forensically downloaded and reviewed, a quantity of Indecent Images of Children were recovered. As a result of this our client was invited back for a second police interview. We arranged for this to take place voluntarily and we obtained disclosure from the police in advance. We prepared a detailed statement on the client’s behalf advancing his defence to these allegations which we submitted in the interview. We subsequently submitted pre-charge representations on our client’s behalf highlighting evidential issues with the prosecution case, namely the presence of cache images. The file was submitted to the Crown Prosecution Service for a charging decision and the CPS returned a decision of No Further Action against the client.

Trading Standards Investigation - No Criminal ChargesList Item 4
Tim was instructed to provide pre-charge representation for a client under investigation by trading standards. Tim successfully persuaded Trading Standards to submit their questions in writing, therefore avoiding the need for a formal interview under caution. Tim drafted answers to these questions, alongside written representations which were submitted to the Trading Standards legal team. Tim also obtained character references from previous customers who the client had done work for. Trading Standards eventually agreed to caution the client for several regulatory breaches but nothing fraudulent.

Tim submitted written representations alongside over 200 pages of supporting evidence including character witness statements, text/facebook messages and bank statements to demonstrate that the allegations were entirely false. Tim was instructed to represent a client who had been charged with Driving with Excess Alcohol and Driving Whilst Disqualified. This was the client’s 3rd conviction for such offences. Tim put together a detailed mitigation bundle which was presented to the court and after our expert mitigation, the magistrates were persuaded to impose a suspended prison sentence.

Assault Against a Police Officer - Charges Dropped At Trial
Tim represented a client for an alleged assault against a police officer. During the course of the trial preparation, it became apparent that one of the interviewing officers had misled the client during the interview, portraying their case to be stronger than it was in order to obtain admissions from the client. Once this had been highlighted, an application was submitted to exclude the interview and the officer was called to give evidence at court. The prosecution offered no evidence on the day of trial.

Tim represented a client at trial facing charges of burglary. Tim was able to demonstrate that the prosecution had failed to comply with their disclosure obligations and therefore successfully applied to exclude the prosecution's forensic evidence. This resulted in no evidence being offered against the client on the day of trial.

Voyeurism Investigation
Tim submitted pre-charge representations for a client facing charges of voyeurism. Initially the police agreed to deal with the matter by way of a caution, but this was subsequently overturned on review. The case was charged and following a guilty plea at court, we successfully mitigated the sentence down to a financial penalty, therefore avoiding notification requirements for the client.

Failing To Provide A Specimen - Acquittal After Trial
Tim represented a client at trial who faced charges of failing to provide a specimen for analysis contrary to the Road Traffic Act 1988. The client had provided 2 evidential breath samples, but the readings were too far apart to be considered reliable. The police tried to take a sample of blood, but were unable to find a suitable vein, despite numerous attempts by a doctor. Finally the police requested a urine sample, which the client tried but failed to provide. At trial, Tim was able to present medical evidence which demonstrated that due to the client’s levels of anxiety, he would have found it difficult to provide a urine sample on demand. The client was found not guilty.

Bladed Article - Acquittal After Trial
Tim represented a client at trial who had been charged with possession of a bladed article. Tim made a successful application to exclude the client’s interview under s.78 of the Police and Criminal Evidence Act on the basis that the police had not sufficiently explained the caution nor the client’s right to legal representation. It was also demonstrated that the client should have had the assistance of an appropriate adult in the interview. The client was found not guilty on the basis that he had good reason/lawful authority for being in possession of the item.
