Our client instructed us to provide pre-charge representation regarding allegations of historic sexual assault. Our client was living and working abroad at the time and so we arranged a suitable date/time for the client to attend a voluntary interview, therefore avoiding the risk of arrest. We obtained disclosure in advance of the interview and drafted a prepared statement on our client’s behalf denying the allegations. We represented our client in police interview and subsequently submitted representations on his behalf to the police evidential review team asserting the reasons why we believed the case did not pass the evidential threshold and therefore no further action should be taken. Our representations were successful and the police took the decision to take no further action against the client. The case was not referred to the Crown Prosecution Service.
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for Rape. Having taken detailed instructions from our client it became apparent there were significant lines of enquiry which we were able to pursue, including speaking with and taking a statement from a key witness. This evidence significantly undermined the allegation that had been made against our client and cast doubt over the credibility of the complainant. We put a bundle of evidence together with representations which we submitted to the police asserting that their case failed on evidential grounds. After a review of this material the police took no further action against our client.
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for Rape. We were able to successfully negotiate a voluntary interview with the police and therefore prevented our client from being arrested. We obtained disclosure prior to the interview and drafted a prepared statement in which we advanced evidence in the form of social media messages which undermined the complainant’s account. We subsequently obtained a witness statement from a key witness which further assisted our client’s defence. We provided this evidence to the police along with representations highlighting the weaknesses in their case. No further action was taken against our client.
We were instructed to provide pre-charge representation on behalf of our client who was under investigation for historic sexual offences against a family member. We arranged a voluntary interview and obtained disclosure from the police in advance. We took instructions from our client who highlighted some significant concerns regarding the complainant’s mental health and recent psychiatric treatment. We drafted a prepared statement putting forward our client’s denials and defence. We followed this up with representations to the police highlighting our concerns regarding the reliability of their evidence. No further action was taken against our client.
We were instructed to provide pre-charge representation on behalf of our client following his arrest on suspicion of Rape. Our client was a student at the time. The complainant alleged that the client had sexual intercourse with her when she was too drunk to consent. After continued conversations with the officer in charge of the case regarding their evidential difficulties the police decided to take no further action against our client.
We were instructed to provide pre-charge representation on behalf of our client following his arrest on suspicion of Possessing Indecent Images of Children. Our client had already been interviewed and was represented by the duty solicitor. Once we were instructed we took detailed instructions from our client and instructed a psychiatrist to conduct a psychiatric assessment. After our client’s electronic devices were forensically downloaded and reviewed, a quantity of Indecent Images of Children were recovered. As a result of this our client was invited back for a second police interview. We arranged for this to take place voluntarily and we obtained disclosure from the police in advance. We prepared a detailed statement on the client’s behalf advancing his defence to these allegations which we submitted in the interview. We subsequently submitted pre-charge representations on our client’s behalf highlighting evidential issues with the prosecution case, namely the presence of cache images. The file was submitted to the Crown Prosecution Service for a charging decision and the CPS returned a decision of No Further Action against the client.
